Why don't these get reported? I think I know....
Someone who enters a home is particularly dangerous in my mind. And one who doesn't leave when told, needs to be dealt with for sure.
The owner's actions will be supported in most states. This took place in California. That state has a Castle Doctrine law and no duty to retreat inside or outside the home. And, Riverside county is more friendly to gun owners.
But we all need to know to shut up. His words, "I tried to scare him more than shoot him," could be used by an anti-gun district attorney to declare that the home owner, by his own admission, was not in fear for his life.
Shooting to scare is like warning shots, implying there was no immediate action that needed to be stopped to save a life or avoid bodily harm.
I agree, Harry. California, being what it is, isn't all that gun-unfriendly. We have a lot of stupid laws, but the overall picture is clearly self-defense friendly. We do have a "Castle Doctrine", and "stand your ground" is a part of it. Simply put, if you are the victim, you have no obligation to retreat, and may meet force with whatever force is necessary to defend yourself, or others. We have a lot of idiotic (and ineffective) possession and gun/ammo-type regulations, but the core principal is sound. This was a tough year with all the stupid new regulation proposals, but most of them failed to be passed. The "open carry" laws are only political talking points, as they only affect those who probably shouldn't be brandishing in the first place. We, the real "carriers", don't care much about "open" carry. There are so many exceptions, it only affects the ones who will give the rest of us a bad name, anyway. Just because you can do something, doesn't mean, necessarily, that you should. The most ridiculous proposals that did pass, were only affecting areas like L.A. and S.F. Well, they make their own laws, and choose which lawful regulations to enforce (or not enforce), anyway. No loss there. Just don't get caught with an Air Soft weapon Daisy Red Ryder (or potato gun, according to the language of the law) in the possession of your unsupervised kids, 'cuz it's now a crime, but only in L.A. I just have to laugh at that one! The state's policies and politics are decided by 6 counties. California has 58. When the 6 visit the 52, they behave, or are dealt with accordingly.
That's one thing I really hate. You can the most honest and best intentions, but someone else can twist your whole meaning and now you're that bad guy.

Which is exactly why you should only speak through an attorney. And, if you carry a gun, you should have one you know already that you can call if ever needed. The time to forge a relationship with counsel is not in a conference room at the county jail.
